New MLS Rule Goes into Effect This Sunday, Important Information and FAQs.

Good Morning,

The new MLS Clear Cooperation rules go into effect this Sunday, March 1, 2020.  Below is a link to a video explaining the rule, and some frequently asked questions we have gotten with answers.

Frequently Asked Questions
Can I still do an Office Exclusive listing?
The Office Exclusive provision is for a listing that you take and only share with agents and brokers in your brokerage.  That is what it means by brokers and licensees affiliated with the listing brokerage.

You can share an office exclusive listing with agents in your brokerage and they can share it directly with their clients.

The communications must be a one-to-one. If you share the listing with one of the agents in your brokerage, and they then share it on their Facebook page or something that is not a one-to-one communication with their client, then the rule would be violated.

As soon as that listing is shared with another agent or broker outside your brokerage or shared in some type of public marketing this rule then takes effect.  At that point, you would have up to 1 business day to put the listing into the MLS as an Active listing.

Does this rule apply to commercial listings?
In our MLS, this rule does not apply to commercial listings.  Commercial is not one of the required property types in our MLS.  If you take a commercial listing, you are not required to put it in the MLS.

Does this rule apply to listings that I take outside the territorial jurisdiction of the MLS?
This rule only applies to listings that are required to be input in our MLS. If you take a listing outside of St Johns County, it would not be required to be entered in our MLS.

Does this rule also apply to coming soon listings?
This rule does apply to coming soon listings as well.  The difference is that with a coming soon listing you are entering the listing into the MLS in the "Coming Soon" status, and not the "Active" status.  Also, remember that coming soon listings must have a coming soon addendum signed, and a coming soon rider must be placed on the sign on the property.  In addition, listings cannot be shown and offers cannot be taken when a property is in the coming soon status.
