I am forwarding to you the latest change to the Ethics & Business Practices
DBPR Rule 61J2-3.009.  This email was received from Sharon Hoydich, Director
of Professional Development, Florida RealtorsR.  The section in quotations
"are the words direct from the DBPR".  The "highlighted sections" are from

I finally heard back from Jocelyn Pomales at the DBPR about the new Ethics &
Business Practices rule.  The following information shown below was just
sent out to us regarding RULE 61J2-3.009.

Please note -  the section in quotations are the words direct from the DBPR.
The highlighted section is mine - added for further clarification.

CONCERNING RULE:

61J2-3.009 Continuing Education for Active and Inactive Broker and Sales
Associate Licensees.

(1) No change

(2)(a) No change

"Licensees must take the 3-hour Core Law course once during each renewal
period. A licensee who takes the 3-hour Core Law course in each year of the
renewal period shall be allowed a total of 3 hours of Core Law education and
3 hours of specialty education toward the 14 hour requirement.

Real estate licensees who hold a license that expires on September 30, 2018,
or thereafter must also take the 3-hour Ethics and Business Practices course
once during each licensure renewal period."

WHAT DOES THIS MEAN FOR THE MEMBERS?  The requirement for licensees to take
the new ETHICS & BUSINESS PRACTICES class will go into effect with the END
OF THE SEPTEMBER 2018 RENEWAL CYCLE.  So the system will start looking for
the completion of an ETHICS & BUSINESS PRACTICES class for those folks
renewing their license by the end of September 30, 2018.  SO --- licensees
renewing by the end of SEPTEMBER 30, 2018 will have to take an ETHICS &
BUSINESS PRACTICES CLASS PRIOR TO THAT DATE TO RENEW THEIR LICENSE.

"A licensee who takes the 3-hour Ethics and Business Practices course in
each year of the renewal period shall be allowed a total of 3 hours of
Ethics and Business Practices and 3 hours of specialty education toward the
14 hour requirement."

"Licensees who complete the Core Law course and Ethics and Business
Practices course will receive 6 hours credit toward the 14 hour requirement.
The "specialty" course hours must total at least 8 hours."

"Also, Ethics courses that were approved prior to 11/30/2016 will not count
towards this Ethics and Business Practices requirements.  The courses need
to be resubmitted as a new course to qualify under the new requirements. The
new forms are located on the forms and publication page of the Division's

"Courses being submitted under the new ETHICS & BUSINESS PRACTICES category
can be submitted for approval from an existing Realtor Code of Ethics
SPECIALTY class (it can also be other types of ethic's courses) but IT MUST
resubmitted under the E&B category."

For your reference, the FLORIDA REALTORS current Code of Ethics 3 hour CE
and 4 hour CE class are currently being submitted under the Ethics &
Business Practices category and should be ready to offer by early fall for
Ethics & Business Practices credit.
